It is the duty of Party to pay all Government Dues. Government Dues may include Property Conversion Charges, Ground Rent, Any Penalty or Installment, Stamp Duty etc.

Frequently Asked Questions

As the term says Leasehold property means buyer has purchased a property on a lease from Delhi Development authority and paying Ground Rent yearly for the same, whereas Freehold property means that the buyer is a sole owner of property and conquer full rights to sale/rent out the property.

  • Once the buyer gets there property converted from Leasehold to Freehold, then he/she will be the absolute owner of the property forever whereas DDA grant the lease to buyer for a specific period of time as mentioned in Documents (usually for 99 years).
  • The owner of the Freehold property conquer full rights to transfer or sale the property without any restrictions whereas the buyer of leasehold property is restricted to perform such actions.

 

  • After getting converted the Property into Freehold, the Property posses an higher sale value of about 15-20% as compare to the Leasehold Property.

 

  • The buyer of Leasehold property has to pay Ground rent (as per cost of flat) to the Delhi Development Authority apart from other property expenses whereas Freehold Property owner is free from such expenses and has to pay only the Property Tax to Municipal Corporation Department.

 

  • Property Loans are easily granted by authorities on Freehold Properties as compare to Leasehold properties.

As per DDA Freehold Scheme and Sources – 
As per the order issued by the Govt. of India, Delhi Development Authority (DDA) has decided to convert the residential flats by executing the Conveyance Deed in the name of Allottee/Purchaser/GPA holder in respect of flats allotted by DDA on freehold basis constructed prior to the year 1992.

Conveyance Deed is a Legal Document which serves a proof of transference of Ownership from one owner (DDA) to another OR we can say it act as a Evidence that one party has legally signed and has transferred the ownership to other party. Conveyance Deed plays a vital role in respect of sale/purchase of property and to claim the Ownership.
After completing the process of Leasehold to Freehold conversion, DDA issue Conveyance Deed to the buyer/owner of property.

SALIENT FEAUTERS OF THE SCHEME

SALIENT FEAUTERS OF THE SCHEME

  1. The scheme covers the following flats:-

Janta, EHS, LIG, MIG, HIG, SFS flat allotted by DDA including the flats in Asian Games Village Complex constructed prior to 1992 on leasehold  basis.

  1. Original sub-lessees/allottees would be entitled to remissions in the conversion charges as specified in Annexure-“A” of DDA Conversion Brochure.
  2. The onetime charges payable for conversion from leasehold to freehold are set out in Annexure-“B” of DDA Conversion Brochure.
  3. The application for conversion into freehold basis shall be submitted alongwith the prescribed documents.
  4. In case the flat is mortgaged, execution of conveyance deed would be allowed on submission of no objection certificate(s) from the           mortgagee/financial
  5. In case of any legal dispute relating to title of the flat, conversion shall not be allowed until the legal dispute is settled.
  6. In case where application for mutation or submission are pending with the lessor/DDA, execution of conveyance deed would be allowed only after the necessary mutation/ substitution has been carried out
  7. The execution of conveyance deed on free hold basis shall be allowed in the cases where allottee has parted with possession of the flat, provided that:
  • Application for execution of conveyance deed into freehold shall be made by the person holding power of attorney/agreement to sell from the allottee to allenate (sale/transfer) the flat.
  • Proof of physical possession of the flat in favour of the person in whose name execution of conveyance deed is being sought on freehold basis shall be submitted.
  • Where there are successive power of attorneys, execution of conveyance deed will be allowed after verifying the factum of possession provided that the linkage of original allottee of the flat with the last power of attorney/purchaser is established and attested copied of relevant documents are submitted.
  • The General Power of Attorney/Agreement to Sell executed from 24.9.2001 onwards, must be registered with the Sub-Registrar.
  1. On receipt of the application in the concerned branch of Housing Wing, the matter is examined and sent to Housing Accounts Section to ascertain the dues position. After obtaining clearance that no dues are pending or dues upto Rs.5,000/- are pending, the matter is decided to issue the Conveyance Deed papers.
  2. If the application is in order, the Conversion application is decided within 45 days

WHO CAN APPLY FOR LEASEHOLD TO FREEHOLD CONVERSION?

  • Any person who is the Original Allottee of DDA Property as per the records of DDA can apply for DDA Freehold service.
  • Any Purchaser/GPA holder as per the records of DDA can apply for the Conversion process on a payment of a surcharge @ 33.1/3 on the conversion charges over and above the normal conversion charges applicable for original allottee can apply for DDA Freehold service.

WHAT ARE THE DOCUMENTS REQUIRED FOR CONVERSION FROM LEASEHOLD TO FREEHOLD?

DOCUMENTS REQUIRED FOR ALLOTTEE OF CGHS FLAT –

  1. Share Certificate
  2. Allotment cum Possession Letter 
  3. NOC from Society
    • Allottee Name, Allottee Address, Membership No., Plinth Area of Society Flat, Details of Ground Rent.
    • NOC must be submitted Original.
  4. ‘D’ Form and Perpetual Lease Deed (Regd.) OR occupancy certificate
  5. Physical Possession
    • Any of the two Addresses Proof Document is required (Passport, Voter I-Card, Adhaar Card, Nationalized Bank Passbook, Electricity Bill etc.)
    • The Address Proof Document must be same as the address of Property which you are applying for Freehold.
  6. No Dues Certificate from Delhi Cooperative Housing Finance Corporation Limited.
  7. In case of Mutatee/Transfer Letter (Blood Relation) he has to deposit the photocopy of letter issued by the DDA.
  8. Seven Passport Size Photograph.

HOW TO PAY DDA FREEHOLD CONVERSION CHARGES?

  • By Online Payment – After computing the conversion charges as per above the Applicant should generate the conversion charges challan from DDA website – http://dda.org.in/to get user ID and Password and after that can make an Online Payment using Debit card/ Credit card/ Net banking.

 

  • By Pay Order/Demand Draft – After computing the conversion charges as per above the Applicant need to prepare a Pay Order/Demand Draft of due value from his/her respective Bank Account and in favor of “Delhi Development Authority”. If payment is to be made manually then he/she should print the challan as well and have to submit it along with Pay Order.

 

  • By RTGS/NEFT – An Applicant can make his/her Payment in the DDA’s following Account No through RTGS/NEFT from anywhere in the world.
